2023 Presidency: Reactions As Supreme Court Fixes May 26 For Judgement On Tinubu’s Eligibility

According to Vanguard, the Supreme Court will rule on an appeal challenging President-elect Ahmed Bola Tinubu’s ability to compete for president in the February 25 election on Friday, May 26. Tinubu is a supporter of the incoming administration’s All Progressives Congress (APC). A SC/CV/501/2023 appeal was brought by the Peoples Democratic Party (PDP) against Tinubu and the Vice President-elect, Senator Kashim Shettima.

The People’s Democratic Party claimed that the Electoral Act, 2022, as modified, was broken when Shettima was chosen as the APC’s and Tinubu’s vice presidential candidate. This included Sections 29(1), 33, 35, and 84(1) and (2). The PDP argued in court that Shettima’s nomination for vice president and the Borno Central senatorial seat was in violation of the law.

In addition to requesting the court to invalidate Tinubu and Shettima’s candidacies, the appellant asked the Independent National Electoral Commission (INEC) to remove their names from the list of nominated or sponsored candidates entitled to participate in the presidential election. After the parties adopted their last briefs of argument, a five-member panel of the Supreme Court led by Justice Inyang Okoro approved the matter for judgment in the interim.
