BREAKING: Amechi Uwani Land Dispute: Evergreen Absent as Court Adjourns Arraignment

An Enugu Magistrate’s Court has adjourned the arraignment of Okah Kingsley Chukwuagozie (also known as Evergreen), who is facing charges of forcible entry, malicious damage, and conspiracy, after he failed to appear.

The case, presided over by Chief Magistrate O.S. Chukwuani on Friday, January 30, 2025, has been adjourned to February 14, 2025, following the defence lawyer, G.O. Asogwa’s statement regarding Chukwuagozie’s illness.

The prosecution, represented by C.C. Ugwu, did not oppose the adjournment.

According to the charges, Chukwuagozie and others who remain at large allegedly entered a property at Ndiaga Amechi Uwani on April 23, 2024, in a manner likely to breach the peace. The land is reportedly owned by Sunday Nnaji White, who was in peaceful possession at the time.

They are also accused of damaging fences, gates, and an ongoing building project valued at over ₦45 million. The alleged offences are punishable under Sections 496(a), 115, and 415(1) of the Criminal Code, Cap 30, Vol. II, Revised Laws of Enugu State 2004.

The court will reconvene on February 14, 2025, for the arraignment.

It should be noted that an Enugu court had previously granted an injunction in a related land matter, restraining Evergreen, other defendants, and their agents from harassing, arresting, constructing on, or selling any portion of the disputed “Ururu Ike Land” in Amodu, until the court addresses the Motion on Notice.
