The Rivers State Government has reacted to the Supreme Court’s dismissal of Governor Siminalayi Fubara’s appeal against the Rivers State House of Assembly, describing the case as purely academic and no longer relevant.
The appeal, SC/CV/1071/2024: Gov of Rivers State v Rivers State House of Assembly & Ors, originated from Suit No. FHC/ABJ/CS/1613/2023, which was filed on November 29, 2023, before Justice James Omotosho at the Federal High Court, Abuja.
According to the state government, the suit was related to the 2024 budget, which has already been fully utilized for the benefit of Rivers residents and became spent on December 31, 2024.
“The appeal is of no useful purpose in 2025, which has its own budget. The only reasonable thing left to do was to withdraw the appeal and have it dismissed,” the statement read.
The government further emphasized that Martin Chike Amaewhule and 26 other lawmakers had defected from the PDP to the APC on December 11, 2023, leading to their seats being declared vacant.
It also clarified that the dismissed appeal had nothing to do with the status of the defected lawmakers, urging the public not to be misled by their propaganda.
