Court Gives 3 Reasons Why Man Arrested For Saying Tinubu Can Never Be Sworn In, Can’t Be Bailed

A Zuba Magistrate Court in Abuja has given three reasons why Obiajulu Uja, man arrested for saying Tinubu can never be sworn in, can’t be granted bail.

On 1st April 2023, a passenger was debarked and handed over to the police for making a sensitive statement about President-elect, Bola Tinubu onboard an Ibom Air Abuja-Lagos bound flight. He was captured on a plane screaming and disturbing the passengers in the plane saying that the president-elect Bola Tinubu can never be sworn in.

Today, the Court has given three reasons why Obiajulu Uja can’t be bailed.

The first reason is the bail application filed by Uja, through his counsel, Senior Magistrate Mohammed Abdulazeez Ismail. Sitting in Zuba, Abuj said that the application was premature.

The second reason is the exhibits attached to the application did not say the Obiajulu was unfit to fail trial but rather indicated he was of unsound mind. He also said that while the constitution guarantees every person’s liberty, a court can deprive a person of their liberty based on health grounds.

The third reason is Citing the provisions of Section 35(1)(e) of the 1999 Constitution of the Federal Republic of Nigeria (as amended) and Section 278 of the Administration of Criminal Justice Act (ACJA), 2015, the Magistrate held that Obiajulu Uja cannot be granted bail.

In addition, the court subsequently turned down the bail application and ordered that Obiajulu Uja be held at the Kuje Correctional Centre of Nigerian Correctional. What are your thoughts on this?
