Court Dismisses PDP Secretariat Blockade Suit, Party Alleges Bias

The Peoples Democratic Party (PDP) has formally withdrawn its legal challenge against the Nigeria Police Force regarding the ongoing blockade of its national secretariat, Wadata Plaza.

The move, announced on Friday, January 23, 2026, was accompanied by a scathing indictment of the Federal High Court’s impartiality.

In a statement by National Publicity Secretary Ini Ememobong, the party revealed it filed a notice of discontinuance in suit FHC/ABJ/CS/2520/2025.

The PDP had originally sought an order to compel security agencies to vacate its headquarters and hand control to the newly elected leadership led by Dr. Tanimu Turaki (SAN).

The party’s decision to exit the courtroom followed the assignment of the case to Justice Joyce Abdulmalik.

The PDP noted that it had previously petitioned the Chief Judge of the Federal High Court, expressing a total lack of confidence in three specific judges, including Justice Abdulmalik, to handle matters involving the party fairly.

Tensions escalated during the proceedings when the judge reportedly refused to prioritize a motion for her recusal.

Instead, Justice Abdulmalik ruled that all pending applications, including the request for her to step down, would be heard alongside the substantive suit and decided only at the judgment stage.

The PDP argued that this procedural choice effectively defeated the right to a fair hearing.

“To this end, we filed a notice of discontinuance as provided for under Order 50 Rule 2(1) of the Federal High Court Rules,” the statement read.

The party emphasised that the notice was filed within the 14-day window following the receipt of the final statement of defense, making the withdrawal a matter of right.

However, a fresh controversy erupted on Friday when the court, rather than striking out the case as is customary for withdrawn suits, ordered its dismissal on the grounds that issues had already been joined.

The PDP described this as a further sign of judicial bias, noting that a dismissal could prevent the party from refiling the matter in another court.
